Welcome to Indigleam ("Indigleam," "we," "us," or "our"), operated by Indigleam LLC. These Terms and Conditions ("Terms") govern your access to and use of indigleam.store (the "Site") and any purchase you make through it. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1.1 Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on Indigleam. By using the Site, you represent that you meet this requirement and that any information you provide is accurate and current.

1.2 Account Registration

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at indigleam12@gmail.com if you suspect unauthorized use of your account.

1.3 Products and Descriptions

We make every effort to display our jewelry — including color, gemstone appearance, and materials — as accurately as possible. However:

  • Colors may vary slightly depending on your device's display settings.
  • Natural materials (gemstones, pearls, sterling silver, gold vermeil) may show minor natural variation in color, inclusion, or finish, which is not considered a defect.
  • Measurements (ring sizes, chain lengths, stone dimensions) are approximate and may vary by up to a few millimeters due to handcrafting processes.

We reserve the right to limit quantities, discontinue products, or correct errors in product descriptions or pricing at any time without prior notice.

1.4 Material & Gemstone Disclosures (FTC Compliance)

In accordance with the FTC Jewelry Guides, Indigleam accurately discloses the composition of all jewelry sold:

  • Precious metals: Product listings specify whether an item is solid gold (with karat purity, e.g. 14K), gold-filled, gold vermeil (sterling silver base with a minimum gold plating thickness and purity as legally required to use the term "vermeil"), gold-plated, or sterling silver (.925). Plated items are labeled with the base metal and plating type.
  • Gemstones: Listings disclose whether a stone is natural, lab-created/synthetic, simulated, or treated/enhanced (e.g., heat-treated, dyed, filled), as required by law.
  • Nickel/allergy disclosure: Where applicable, we note if an item contains nickel or nickel alloys, as some customers have metal sensitivities. Items marked "hypoallergenic" use nickel-free or surgical-grade materials.

1.5 California Proposition 65 Warning

WARNING: Some jewelry items sold by Indigleam may contain trace amounts of lead, cadmium, or other substances known to the State of California to cause cancer, birth defects, or other reproductive harm. This warning is provided in compliance with California's Proposition 65. For more information, visit www.P65Warnings.ca.gov.

1.6 Pricing and Payment

  • All prices are listed in USD unless otherwise stated.
  • We reserve the right to change prices at any time before an order is confirmed. Confirmed orders will be honored at the price paid.
  • Sales tax will be applied based on your shipping address in accordance with applicable state law.
  • We accept the payment methods listed at checkout (e.g., major credit/debit cards, and third-party processors such as PayPal, Shop Pay, Apple Pay, or Klarna where offered). Payment is processed securely through our third-party payment gateway; Indigleam does not store your full payment card details.
  • In the event of a pricing error due to a technical or typographical mistake, we reserve the right to cancel the order and issue a full refund, even after confirmation.

1.7 Order Acceptance

Receipt of an order confirmation email does not constitute our acceptance of an order; it is confirmation that we received your order request. We reserve the right, at our sole discretion, to refuse or cancel any order for reasons including but not limited to: suspected fraud, product unavailability, pricing errors, or violation of these Terms. If your order is canceled after payment, you will receive a full refund.

1.8 Intellectual Property

All content on this Site — including but not limited to logos, product photography, designs, graphics, text, and the Indigleam name and branding — is the property of Indigleam LLC or its licensors and is protected under applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

1.9 Website Technical Support Disclosure

The Site's technical infrastructure, hosting, and maintenance are supported by Cypher IT Solutions. Cypher IT Solutions provides technical support services only — including website functionality, hosting, and troubleshooting — and has no role in, and bears no responsibility for, product sourcing, product listings, product uploads, inventory, pricing, order fulfillment, or the accuracy of product descriptions. All product-related content and commerce operations are managed solely by Indigleam LLC. Any questions about products, orders, or the content of listings should be directed to Indigleam at indigleam12@gmail.com, not to Cypher IT Solutions.

1.10 User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or computer systems connected to the Site.
  • Use automated means (bots, scrapers) to access or extract data from the Site without permission.
  • Upload or transmit viruses, malicious code, or content that infringes on the rights of others.

1.11 Reviews and User-Generated Content

If you submit a product review, comment, photo, or other content to the Site or tag us on social media, you grant Indigleam a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content for marketing and promotional purposes. You represent that any content you submit is your own and does not infringe on any third party's rights.

1.12 Limitation of Liability

To the fullest extent permitted by law, Indigleam LLC and its officers, employees, and affiliates (including third-party service providers such as Cypher IT Solutions, acting solely in their technical support capacity) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or products purchased, including but not limited to loss of use, loss of data, or loss of profits, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site or a purchased product shall not exceed the amount you paid for the product giving rise to the claim.

1.13 Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis. Except as expressly stated in our Return & Refund Policy, Indigleam disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by applicable law.

1.14 Jewelry Care & Assumption of Risk

Jewelry sold by Indigleam is intended for normal wear and should be cared for according to the care instructions provided with your order (avoiding contact with water, perfume, lotion, and chemicals; storing in a dry place, ideally in an airtight pouch). Indigleam is not responsible for damage, tarnishing, or discoloration resulting from improper care, normal wear and tear, or misuse.

1.15 Third-Party Links

The Site may contain links to third-party websites (e.g., social media, payment processors). We are not responsible for the content, privacy practices, or terms of any third-party site.

1.16 Accessibility

1.17 Indemnification

You agree to indemnify and hold harmless Indigleam LLC, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.
